By accessing or using Moniterix (the "Service"), operated by Sial Tech ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including the website (moniterix.com), web dashboard (app.moniterix.com), and desktop agent application.
Moniterix is a team performance intelligence platform that provides employee monitoring, time tracking, project management, and business analytics tools. The Service includes a web-based dashboard for managers and a desktop agent application for team members.

You must be at least 16 years old to create an account. If you are creating an account on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
New accounts may receive a 14-day free trial with full access to Business plan features. No credit card is required for the trial. At the end of the trial, you must select a paid plan to continue using the Service.
Paid plans are billed monthly or annually as selected at time of purchase. All fees are quoted in US dollars and are non-refundable except as required by law or as described in our Refund Policy (Section 4.4).
We reserve the right to change pricing at any time. Existing subscribers will receive at least 30 days' notice before any price increase takes effect. Price changes will apply at the next billing cycle after the notice period.
Annual subscriptions may be eligible for a prorated refund within the first 30 days if the Service does not meet your reasonable expectations. Monthly subscriptions are non-refundable. Contact support@moniterix.com to request a refund.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Moniterix provides the tools; you are responsible for their legal and ethical deployment within your organization.
The Service, including its original content, features, and functionality, is owned by Sial Tech and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
You retain full ownership of your data. We claim no intellectual property rights over the screenshots, activity data, or business information you store in the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice for scheduled maintenance whenever possible.
To the maximum extent permitted by law, Sial Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Sial Tech, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination:

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
